Welcome to Breeze Education LLC (“Breeze Education,” “we,” “us,” or “our”). We respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, use our PANCE preparation software, and interact with our services (collectively, the “Service”).

By accessing or using our Service, you consent to the collection, use, disclosure, storage, and processing of your information in accordance with this Privacy Policy as described herein and in our Terms of Service. If you do not agree with the terms of this Privacy Policy, please do not access the Service.

The Service may be hosted or operated in countries other than the country in which you reside. By using the Service, you consent to the transfer, storage, and processing of your information in jurisdictions outside your home country, which may have different data protection laws.

We collect information that identifies, relates to, describes, or could reasonably be linked to you (“Personal Information”) in the following ways:

A. Information You Provide Directly

Account Information: When you register for an account, we collect your first and last name, email address, and account password.

Billing Information: When you purchase a subscription, you provide payment information. Please note: We use a secure third-party payment processor (e.g. Stripe) to process all transactions. Breeze Education does not store raw credit card numbers or bank account information on our servers; such information is handled by the payment processor.

Communications: Information you provide when you contact us for customer support, report a bug, or otherwise communicate with us.

B. Test-Prep & Performance Data: To provide our educational services, we collect data regarding your use of the platform, including:

Exam and quiz scores.

Specific question responses and time spent per question.

Study progress, academic strengths and weaknesses, and general behavioral analytics related to your PANCE preparation.

C. User-Generated Content: Our Service allows users to create, study, and share flashcards. We collect the content you create, including custom study notes and flashcard decks. If you choose to share your flashcard decks via a shareable link or upload them to the "Community Decks" feature for others to use and upvote/downvote, that specific content will be collected and stored for that purpose.

D. Information Collected Automatically: When you access the Service, we automatically collect certain technical information, including:

Device and Usage Data: Your IP address, browser type, operating system, and the dates/times you access the Service.

Security Logs: We monitor network traffic and log data to maintain the security of the platform, enforce our Terms of Service, detect unauthorized account sharing or automated scraping, and investigate misuse.

Cookies and Tracking Technologies: We and our analytics partners may use cookies, persistent identifiers, web beacons, and similar tracking technologies to track activity on our Service and store certain information.

Mobile Device: When you access or use the Service using a mobile device, we may collect device identifiers and advertising IDs. If you use location-based features, we may collect GPS or similar location information. This data helps us understand usage patterns, improve functionality, and deliver relevant content.

2. How We Use Your Information

We use the Personal Information we collect strictly for business and operational purposes, including:

To Provide and Maintain the Service: Creating your account, processing your subscription, and delivering the PANCE curriculum.

To Personalize Your Experience: Using your performance data to adapt the curriculum, track your academic progress, and provide tailored study recommendations.

To Improve the Platform: Debugging the website, fixing errors, and analyzing how users interact with our Service to improve our features.

To Communicate With You: Sending you transaction receipts, password resets, account alerts, responses to your customer service inquiries, and marketing messages, including newsletters, promotions and offers. You may opt out of marketing messages at any time by following the instructions in those emails.

For Security and Enforcement: Detecting and preventing fraud, unauthorized access, scraping, and enforcing our Terms of Service.

Combined/Aggregated Data: Combining information collected from multiple sources and anonymizing or aggregating it for analytics, research, or Service improvement purposes.

For Research and Analytics: Collecting and analyzing usage patterns, engagement metrics, and performance data to understand how the Service is used, evaluate effectiveness, optimize features and content, and conduct surveys or research to improve the Service.

3. How We Share Your Information

We do not sell your Personal Information to third parties. We only share your information in the following limited circumstances:

With Service Providers: We share information with trusted third-party vendors who perform essential services on our behalf, such as payment processing, cloud hosting, and data analytics (e.g. Google Analytics). These providers are contractually obligated to protect your information and only use it for the services they provide to us.

With Institutional & Third-Party Payers: If your access to the Service was purchased by or provided through a third party, such as a university, PA program, employer, or scholarship, we may share your activity, performance data, and exam scores with the administrators of that paying institution.

Community & Publicly Shared Content: If you choose to publish a flashcard deck to the "Community Decks" section or share it via a public link, the contents of that deck will be visible to other users. While we employ screening measures, we ask that you do not include sensitive personal information (such as your email or phone number) in your flashcards, as we cannot guarantee the privacy of user-generated content you choose to make public.

Business Transfers: If Breeze Education is involved in a merger, acquisition, or sale of all or a portion of its assets, your information may be transferred as part of that transaction.

Legal and Safety Requirements: We may disclose your information if required to do so by law, in response to a valid subpoena or court order, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to track activity on our Service and store certain information. Cookies may include:

Essential Cookies: Required for the operation of the Service, such as keeping you logged into your account.

Analytics Cookies: Used to track usage patterns with third-party tools like Google Analytics. You may opt out of Google Analytics by using the Google Analytics Opt-out Browser Add-on.

Do Not Track (DNT) Signals: At this time, we do not alter our data collection and use practices in response to Web browser “Do Not Track” signals. Third-party services may still collect information subject to their own policies.

Security: We use administrative, technical, and physical security measures (including secure HTTPS encryption) to protect your Personal Information. However, no system can guarantee 100% security, so you acknowledge that transmissions and storage are not fully secure.

Retention: We retain your Personal Information as long as necessary to provide you the Service, comply with our legal obligations, resolve disputes, and enforce our agreements.

Institutional Account Retention: If your account is managed or paid for by an institution or PA program, data retention and deletion are subject to the policies of that institution. In such cases, requests to delete student data must be approved by the institutional administrator.

Depending on your state of residence (including but not limited to California, Colorado, Connecticut, Virginia, Texas, and Utah), you may have certain rights regarding your Personal Information.

Because we do not sell your Personal Information or share it for cross-context behavioral advertising (targeted ads), your primary rights include:

The Right to Access: You may request a copy of the specific pieces of Personal Information we have collected about you.

The Right to Correction: You may request that we correct inaccurate Personal Information we maintain about you.

The Right to Deletion: You may request that we delete your Personal Information, subject to certain legal and business exceptions (and subject to institutional approval if your account is managed by a university).

The Right to Non-Discrimination: You will not receive discriminatory treatment from us for exercising your privacy rights.

How to Exercise Your Rights: To submit a privacy request, please email us at support@breezeed.com. For your security, we will need to verify your identity (typically by communicating through the email address associated with your account) before fulfilling your request.

7. Children’s Privacy

Our Service is designed strictly for adults and PA (Physician Assistant) students. We do not knowingly collect Personal Information from children under the age of 13. If you become aware that a child has provided us with Personal Information, please contact us, and we will take steps to delete such information from our systems.

8. Third-Party Links

Our Service may contain links to third-party websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

9. Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top.
